Terms of Use

1. Acceptance of Terms

By accessing or using Touge Atlas (the "app"), downloading the app from the Apple App Store or Google Play Store, or visiting tougeatlas.com (the "site"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree, do not use the app or site.

We reserve the right to update these Terms at any time. Continued use of the app after changes constitutes acceptance of the updated Terms. The "Last updated" date at the bottom of this page reflects the most recent revision.

2. Permitted Use

Touge Atlas is provided as an informational resource for personal, non-commercial discovery of driving routes, passes, circuits, and automotive locations in Japan. You may use the app to:

• Browse and search location and event data for personal planning.
• Save favorites for personal reference.
• Contribute photos or suggest locations via the designated submission form.

3. End-User License

Subject to your compliance with these Terms, Touge Atlas grants you a limited, non-exclusive, non-transferable, revocable license to download and use the app on devices you own or control, solely for personal, non-commercial purposes.

This license does not grant you any right, title, or interest in the app or its content beyond what is expressly stated here. All rights not explicitly granted are reserved by Touge Atlas.

You acknowledge that updates or new versions of the app may be released from time to time. These updates may be required for continued use and may be installed automatically. You agree that Touge Atlas has no obligation to provide updates or to continue supporting older versions of the app.

This license is effective until terminated. It terminates automatically if you fail to comply with any provision of these Terms. Upon termination, you must cease all use of the app and delete all copies from your devices.

4. Prohibited Uses

You must not use Touge Atlas or its API for any of the following:

• Scraping or bulk extraction. You may not use automated scripts, bots, crawlers, or any other method to systematically scrape, harvest, or bulk-download location data, event data, images, or any other content from the app, website, or the Touge Atlas API.
• Database replication. You may not reproduce, redistribute, or incorporate our curated location or event database — in whole or in part — into any competing product, service, commercial application, or third-party dataset.
• Unauthorized API access. You may not attempt to access the Touge Atlas API by reverse engineering the app, extracting API keys or credentials from the app bundle, or circumventing any access controls.
• Service disruption. You may not attempt to overload, attack, or disrupt the app or API infrastructure.
• Illegal use. You may not use the app for any purpose that violates applicable law.

Violation of these restrictions may result in your access being blocked and may expose you to legal liability under copyright law, computer fraud law, and other applicable statutes.

5. Intellectual Property

All content in Touge Atlas — including the curated location database, event listings, route data, descriptions, photographs, graphics, logos, and software — is the property of Touge Atlas or its content contributors and is protected by copyright and other intellectual property laws.

The selection, arrangement, and curation of the location database constitutes an original creative work protected by copyright law as a compilation (and by database rights where applicable). This protection applies regardless of whether individual factual data points are independently copyrightable.

You may not reproduce, distribute, modify, reverse engineer, or create derivative works from any Touge Atlas content without explicit written permission from Touge Atlas.

6. User Submissions

If you submit a location suggestion, photo, or other content through the app or website, you grant Touge Atlas a perpetual, worldwide, royalty-free license to use, display, and distribute that content in the app and related marketing. You confirm that you own or have permission to submit the content and that it does not infringe any third party's rights.

7. In-App Purchases and Subscriptions

Touge Atlas offers optional paid features, including Atlas Pass (an auto-renewable subscription) and Trip Plans (one-time purchases of curated driving itineraries).

Atlas Pass is available in the following plans:

• Atlas Pass Monthly — 980 yen per month, auto-renews every month.
• Atlas Pass Annual — 3,980 yen per year, auto-renews every year.
• Atlas Pass Lifetime — 7,800 yen, one-time purchase, no renewal.

Trip Plans are available as one-time purchases at 480, 980, or 1,480 yen per plan. Prices may vary by region and are shown in local currency in your app store.

7.1 Pricing and Payment

All purchases are processed by Apple (via the App Store) or Google (via Google Play). Touge Atlas does not directly process payments or store your payment information. Prices are displayed in the respective app store at the time of purchase, may vary by region, and include applicable taxes.

7.2 Subscription Auto-Renewal

Atlas Pass Monthly and Annual subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the next renewal date. Renewal is charged to the payment method on file with Apple or Google.

7.3 Cancellation

You may cancel your subscription at any time through your device's subscription management:

• iOS: Settings > [Your Name] > Subscriptions
• Android: Google Play > Subscriptions

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period. No pro-rata refunds are provided for partial billing periods.

7.4 Lifetime and Trip Plan Purchases

Atlas Pass Lifetime and Trip Plan purchases are one-time, non-refundable digital content purchases. Once purchased, access is permanent and tied to your account.

7.5 Refunds

Since all payments are processed by Apple or Google, refund requests must be directed to the respective platform per their refund policies. Touge Atlas cannot process refunds directly.

7.6 Price Changes

We may change subscription or purchase prices from time to time. Price changes for subscriptions will take effect at the start of the next billing period following the date of the price change. Where required by Apple or Google, you will be notified of price changes in advance and given the opportunity to cancel before the new price takes effect.

8. Content Accuracy Disclaimer

Location data, event information, road conditions, and all other content are provided for informational purposes only. Information may be incomplete, inaccurate, or outdated. Always verify conditions with official local sources before visiting any location. Touge Atlas makes no guarantee regarding the accuracy, completeness, or timeliness of any information.

9. Driving and Safety Disclaimer

Touge Atlas is an informational and cultural archive. We do not condone speeding, reckless driving, street racing, drifting on public roads, or any other dangerous or illegal driving behaviour. All driving must be conducted within the limits of local law and with appropriate safety precautions.

We are not responsible for any accidents, injuries, fines, legal consequences, or other outcomes arising from your use of the app or your driving behaviour. Use the app responsibly.

10. Third-Party Disclaimer

Touge Atlas is not affiliated with, endorsed by, or acting as an agent for any event organizer, circuit, business, or location listed in the app. All third-party listings are provided for informational purposes only. We do not sell tickets, make bookings, or take responsibility for any third-party services.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Touge Atlas and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the app or any content within it.

Nothing in these Terms excludes or limits our liability for fraud, wilful misconduct, or gross negligence, or any other liability that cannot be excluded or limited under applicable law.

12. Termination

We reserve the right to suspend or terminate access to Touge Atlas at any time, without prior notice, for breach of these Terms or for any other reason including misuse of the API or attempts to extract data in violation of Section 4.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Japan. Any disputes arising from these Terms or your use of the app shall be subject to the jurisdiction of the Tokyo District Court as the court of first instance.

14. Third-Party Services and Attribution

Touge Atlas uses the following third-party services and data sources in the operation of the app:

• Mapping provider for map tile rendering.
• WeatherAPI.com for weather data. Weather data provided by WeatherAPI.com.
• Subscription management provider for subscription and purchase management.
• Analytics service for optional, anonymized usage analytics.
• Database provider for authentication and database hosting.
• Cloudflare for API hosting and content delivery.
• OpenCelliD for cell tower coverage data (CC-BY-SA 4.0 license).

Each service is subject to its own terms and privacy policy. Touge Atlas is not responsible for the availability, accuracy, or practices of third-party services.

16. Apple App Store Terms

The following additional terms apply when you download Touge Atlas from the Apple App Store. These terms are required by Apple and supplement the rest of this agreement.

16.1 Acknowledgement

This agreement is between you and Touge Atlas only, and not with Apple Inc. ("Apple"). Touge Atlas, not Apple, is solely responsible for the app and its content.

16.2 Scope of License

The license granted to you is limited to a non-transferable right to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms of Service. This includes use by other accounts associated with you via Family Sharing or volume purchasing.

16.3 Maintenance and Support

Touge Atlas is solely responsible for providing maintenance and support services for the app. Apple has no obligation whatsoever to provide any maintenance or support services with respect to the app.

16.4 Warranty

Touge Atlas is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app.

16.5 Product Claims

Touge Atlas, not Apple, is responsible for addressing any claims you or any third party may have relating to the app or your possession and use of the app, including but not limited to: (a) product liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.

16.6 Intellectual Property Claims

In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, Touge Atlas, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.

16.7 Legal Compliance

You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

16.9 Third-Party Terms

You must comply with applicable third-party terms of agreement when using the app, including the terms of your wireless data service agreement.

16.10 Third-Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary thereof.
